1. About These Terms
These Terms and Conditions (‘Terms’) govern your use of the World Color Services Ltd website (worldcolorservices.co.nz) and any services provided by World Color Services Ltd (‘we’, ‘us’, ‘our’). By using our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
World Color Services Ltd is a New Zealand company providing residential, commercial, and industrial painting services throughout the Auckland region.
2. Quotes and Pricing
All quotes provided by World Color Services Ltd are:
- Free and provided with no obligation to proceed
- Valid for 30 days from the date of issue unless otherwise stated
- Itemised in writing prior to any work commencing
- Subject to change if the scope of work changes after the quote is accepted
Our quotes are based on a site assessment. Final pricing may be adjusted if unforeseen conditions are discovered once work commences (e.g. hidden rot, structural defects, or substrate issues). We will notify you and obtain approval before proceeding with any variation to the quoted scope.
3. Acceptance of Quote
A quote becomes a binding agreement when you provide written or verbal acceptance. By accepting a quote, you confirm:
- You are the property owner or have authority to authorise painting work on the property
- The information provided to us about the property and project is accurate
- You have reviewed and accept these Terms
4. Payment Terms
Unless otherwise agreed in writing:
- A deposit of 20% of the total quoted amount is required prior to work commencing on projects over $1,000
- Progress payments may be required for large or multi-stage projects, as agreed in the quote
- Final payment is due within 7 days of job completion and final walkthrough
- We accept payment by bank transfer, credit card, or cash
Overdue accounts may incur an interest charge of 1.5% per month on the outstanding balance. We reserve the right to suspend or terminate work on any project where payment is overdue.
5. Workmanship Guarantee
World Color Services Ltd provides a 5-year workmanship guarantee on all completed projects, subject to the following conditions:
- The guarantee covers defects in workmanship, including peeling, flaking, or adhesion failures caused by our application
- The guarantee does not cover damage caused by normal wear and tear, substrate movement, natural weathering, vandalism, or modifications made by others
- The guarantee is void if the painted surfaces are repainted or altered by a third party without our prior written consent
- Paint manufacturer warranties are separate and governed by the respective manufacturer’s terms
To make a guarantee claim, please contact us in writing within the guarantee period. We will arrange an inspection and, if the claim is valid, remedy the defect at no cost to you.
6. Cancellation and Postponement
If you wish to cancel or postpone a confirmed job:
- Cancellation with more than 5 business days’ notice: no cancellation fee
- Cancellation with 2–5 business days’ notice: a fee of 10% of the quoted amount may apply to cover scheduling and material costs
- Cancellation with less than 2 business days’ notice: a fee of up to 20% of the quoted amount may apply
World Color Services Ltd reserves the right to postpone or reschedule work due to weather conditions, illness, or other circumstances outside our reasonable control. We will notify you as early as practicable.
7. Your Responsibilities
To allow us to carry out work safely and efficiently, you agree to:
- Ensure safe and clear access to all areas where work is to be carried out
- Remove or secure fragile, valuable, or irreplaceable items before work commences
- Ensure any pets are secured away from work areas
- Notify us of any known hazards on the property (e.g. lead paint, asbestos)
- Provide a safe working environment in compliance with New Zealand health and safety legislation
8. Health and Safety
World Color Services Ltd complies with the Health and Safety at Work Act 2015 (New Zealand). We maintain public liability insurance and all staff are trained in safe working practices. We reserve the right to stop work if conditions on-site are deemed unsafe, and will not resume until the hazard has been addressed.
9. Liability
To the extent permitted by New Zealand law:
- Our liability to you for any claim arising from our services is limited to the value of the services provided under the relevant quote
- We are not liable for any indirect, consequential, or special loss or damage
- Nothing in these Terms limits or excludes any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986
10. Intellectual Property
All content on the World Color Services Ltd website, including text, images, logos, and design, is owned by or licensed to World Color Services Ltd. You may not reproduce, distribute, or use this content without our prior written consent.
11. Website Use
You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. We reserve the right to restrict access to our website at any time without notice.
12. Changes to These Terms
We may update these Terms from time to time. Updated terms will be posted on our website with a revised effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the New Zealand courts.
